    Don’t get me wrong, ethically this situation becomes very complex, but let’s not kid ourselves: the evidence is unfortunately very strong. In fact this is one of the easier cases for the prosecution to try imo.

    To prove intent under the statute of Murder 2 in NY they have:

    • a weapon him
    • matching shell casings
    • video evidence
    • cellphone data linking him to a route away from the scene

    Cause of death is self-evident.

    There is no legal justification applicable here (self defense, …)

    There’s also a chance this will get a terrorism enhancement. Supporting evidence would be the targeted nature, the casings and manifesto.

    He can go for an insanity plea or extreme emotional disturbance, however this usually goes to the punishment phase and not the trial phase, making this almost irrelevant for the conviction.

    The one thing he has going for him is jury nullification. This is legally dubious and usually can and should not be argued, for very legitimate reasons; however the jury can make their decision basically without justification and therefore this is very plausible. The probability is a different question which is hard to answer.

    I do not like murder, but I sympathize a lot with him, however especially because of that I also have to keep it realistic and accept that legally the case against him is pretty strong.

    TL;DR there’s strong evidence against him, and if there’s no jury nullification he will most likely be convicted.




  • I switched during the third party app thing. I still Google “problem reddit” if I need good answers but Lots of stuff from reddit I never needed and some stuff was actually throwing me off. The insanely strict rules, mods on Reddit being assholes (there’s less of them on Lemmy I wanna think) and the depression inducing pessimism.

    I cut out politics from my feed (works 90% of the time) and always browse “new”. Good memes, some niche communities and a very diverse and interesting community. Sometimes a little bit too forceful in their perspective but I love all the lemmings on here.

    So how did I do it? I think it was a natural fit for me. But only browsing “new”, avoiding politics and joining some niche communities helped.

    Also no one is forcing you :)

    Take your time and maybe when the time is right you will wanna switch over completely. No one will force you on here, but I think that’s exactly why this platform is so good.





  • God fucking shit it breaks me heart to hear that. I’m so sorry for your loss.

    My mom is quite pro science and my dad became a bit spiritual, conspiratorial and anti-science, but none of them were hit that hard. I feel like I’m in the opposite situation where I technically can try to convince him to change his mind every time I see him but he is extremely stubborn and there’s no way. In fact it will make him dig in deeper and the only way for him to change is by himself.

    Fuck this timeline I want a reroll.




  • Hateful is always a weird word imo because it describes that the Internet is full of hate, and I’m sure there’s lots of it. However, the Internet is vast and you will find too much of everything everywhere. So theres platforms with abnormal amounts of positivity and hate, but there’s also platforms for weird niches, platforms for scientific discourse and everything.

    So generally I would say no to both. Lemmy tends to skew a bit towards Europe and towards elitist but that’s a very light skew and I’m still trying to assess tropes you find lots of on here. Well except for reddit hate. But that’s historical.



  • I am not a feminist.

    Feminism has a variety of different flavors with sets of specific ideals that are not a priority in my view, however the basic idea of equal rights is definitely important to me. The more I think about it, the less I feel I know what I’m talking about which is also why I don’t wanna signify I have strong foundational knowledge on this topic. “Equality” is kind of baseline and not what you expect most kinds of feminism to expand to.
